1. About the Platform

Openmart Marketplace (“Openmart,” “we,” “us,” or “our”) is a peer-to-peer classifieds platform that connects buyers and sellers across Nigeria. We provide the technology for users to list, discover, and communicate about goods and services. Openmart is not a party to any transaction — we facilitate the connection, but all deals are made directly between users.

2. Eligibility

To use Openmart Marketplace, you must:

• Be at least 16 years of age.
• Provide accurate and truthful registration information.
• Not have had a previous account suspended or banned by us.
• Have the legal capacity to enter into a binding agreement under Nigerian law.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone. You are responsible for all activity that occurs under your account.

You agree to provide accurate information when registering and to keep your profile details (name, phone, location) up to date. Impersonating another person or using a false identity is strictly prohibited.

You may only hold one active account. Creating multiple accounts to circumvent a ban or manipulate ratings is not allowed.

4. Listings & Selling

When you create a listing on Openmart, you agree that:

• You own the item or have the legal right to sell it.
• All information in the listing — title, description, price, condition, and photos — is accurate and not misleading.
• The item is physically available and ready to sell.
• Listing prices are in Nigerian Naira (₦).
• You will respond promptly to genuine buyer enquiries.
• You will remove or mark as sold any listing that is no longer available.

Openmart reserves the right to remove any listing at any time without notice if it violates these terms or applicable law.

5. Buying

As a buyer, you agree to:

• Contact sellers only with genuine interest in purchasing.
• Inspect items thoroughly before completing a purchase.
• Honour any agreement you make with a seller.
• Leave honest and fair reviews after completing a transaction.
• Not use the chat feature for spam, harassment, or any non-purchase purpose.

6. Prohibited Content & Conduct

The following are strictly prohibited on Openmart Marketplace:

• Illegal items — weapons, drugs, counterfeit goods, stolen property, or any item banned under Nigerian law.
• Adult content — explicit or sexually suggestive material.
• Fraud — fake listings, misleading descriptions, scam offers, or advance-fee fraud (419).
• Harassment — threatening, abusive, or discriminatory messages to other users.
• Spam — duplicate listings, unsolicited messages, or automated bot activity.
• False reviews — posting fake ratings about yourself or others.
• Privacy violations — sharing another user’s personal information without consent.
• Platform abuse — attempting to hack, scrape, or reverse-engineer the platform.

Violations may result in immediate account suspension and reporting to relevant authorities.

7. Transactions & Payments

Openmart does not process payments. All transactions are agreed and completed directly between buyers and sellers, typically in person. We strongly recommend:

• Meeting in a safe, public location.
• Inspecting the item before paying.
• Using secure payment methods (bank transfer, POS) rather than cash for high-value items.
• Never sending money before seeing and confirming the item.

Openmart is not responsible for any disputes, losses, or fraud arising from transactions between users. Any payment issue is solely between the buyer and seller.

8. Safety

Your safety is your responsibility. Openmart strongly advises:

• Always meet in a busy public place (market, shopping mall, bank premises).
• Tell someone you trust where you are going.
• Do not travel to a stranger’s home or invite them to yours for a first meeting.
• Trust your instincts — if something feels wrong, walk away.
• Report suspicious users or listings to us immediately.

Openmart shall not be liable for any personal harm, theft, or loss arising from a physical meeting arranged through the platform.

9. Reviews & Ratings

After a transaction, buyers may leave a review and star rating on a seller’s profile. Reviews must be:

• Based on a genuine, first-hand transaction experience.
• Honest, factual, and not defamatory.
• Free from personal attacks, hate speech, or inappropriate language.

Openmart reserves the right to remove reviews that violate these guidelines. Sellers may not offer incentives in exchange for positive reviews.

10. Intellectual Property

All content on the Openmart platform — including the logo, design, code, and written content — is owned by Openmart Marketplace and protected under applicable Nigerian and international intellectual property law. You may not copy, reproduce, or distribute platform content without written permission.

By uploading photos or content to your listings, you grant Openmart a non-exclusive, royalty-free licence to display that content on the platform for the purpose of operating the service.

11. Limitation of Liability

To the fullest extent permitted by Nigerian law, Openmart Marketplace shall not be liable for:

• Any loss arising from a transaction between users.
• Inaccurate or misleading information in a user’s listing.
• Platform downtime, data loss, or technical errors.
• Harm arising from a physical meeting between users.
• Any indirect, incidental, or consequential damages.

The platform is provided “as is” without warranties of any kind, express or implied.

12. Account Termination

Openmart may suspend or permanently ban your account at any time, with or without notice, if we believe you have violated these Terms. You may also delete your own account at any time by contacting support.

Upon termination, your listings and public profile will be removed. Some information may be retained where required by law.

13. Governing Law

These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from the use of this platform shall be subject to the jurisdiction of Nigerian courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
